Beware the Christmas Post!

 The EAT have recently handed down a judgment regarding the deadline for returning ET3 Tribunal Response Forms to the Tribunal.  The case clarifies that the 28 day return time runs from the date the Tribunal sent the form to the Respondent and not the date the Respondent receives it (as was the case before 2004). A few days in the Christmas post can therefore eat in to your 28 days. If the form gets lost in the post, it is possible that employers could be out of time before they even receive the form! The moral of this case is do not leave returning ET3s until the last minute and check the date the Tribunal sent it to you.
