A topical decision with Good Friday and Easter Monday rapidly approaching, the Scottish court of session (an apellate Court in Scotland whose decisions are not strictly binding in England, but are pursuasive) has confirmed that if you don’t normally work on a Monday, you are not entitled to bank holidays that fall on a Monday (isn’t life tough). The same applies to bank holidays falling on any other day. Well it’s official, the meanest employers are located in ………………………………………………………………………………….
yes, you guessed it, the East Midlands. We’ve worked this out by looking at the data on the DTI site looking at percentage number of employees per region who will benefit when the statutory minimum number of holidays is raised from 20 to 24 later this year and from 24 to 28 in 2008. A staggering 23% of the workforce would benefit in the East Midlands, which to be fair, came joint top (or bottom) depending on your point of view, with London. Crunch the data here.

The DTI has today published its response to the consultation regarding increasing employees’ holiday entitlement. The upshot is that consultation is now underway regarding draft regulations that will entitle employees to 24 days of annual leave from October 2007 and 28 days of annual leave from October 2008. The Employment Appeal Tribunal has held that the Working Time Regulations do apply to workers on the North Sea Oil Rigs UK Continental Shelf. In particular that workers are entitled to holiday under the WTR. What the EAT has not determined is where exactly the worker goes for the holiday, when he/she is stuck on the rig, and who pays for them to go back to mainland! A popular query about whether a part time worker who does not work on a Monday is entitled to time off in lieu when bank holidays fall on a Monday has been answered in this case Download working_mondays.doc The answer is part time employees are not entitled to time off in lieu for Bank Holidays where those Bank Holidays fall on a day they do not work.
