Cut your losses and stop digging

When you are in a hole, sometimes you must stop digging. The cases reported here and here illustrate the maxim neatly. Both Claimants lost their Tribunal claims, one was ordered to pay £5,000.00 costs, the other £7500.00. Both appealed to the EAT, both lost their appeals and both were ordered to pay a further £2000.00 costs. Ouch!
