Disclosure

Disclosure is the way each party in an Employment Tribunal case finds out about documents the other party has which are relevant to the case.  Tribunals often issues standard directions about disclosure requiring the parties to exchange lists of documents and to allow for inspection (or provide copies) thereafter.  Each party is under an obligation to disclose all relevant documents whether or not they are helpful or unhelpful to their case.

If one party does not disclose documents the other thinks are relevant or delays in doing so it is possible to apply to the Tribunal for an order that the documents are disclosed.
