Discriminatory Job Adverts

The Age Discrimination Regulations have now been in force for 7 weeks. We are still seeing a number of indirectly discriminatory adverts. An advert is indirectly discriminatory if it contains a criterion that certain age groups will find more difficult to comply with than other age groups. For example most older applicants will not have sat GCSEs and therefore an advert looking for applicants with GCSEs is likely to discriminate against older applicants. It is permissible to have an indirectly discriminatory criterion if it can be objectively justified, but in many cases it will be difficult to do so.
Even more worryingly, we are still seeing some adverts that directly discriminate, for example by asking for young applicants. Defences to direct discrimination are very limited therefore direct discrimination really should be avoided!
