Double Your Money

 The Court of Appeal have decided that in Unfair Dismissal Claims employees are entitled to Pay In Lieu of Notice (PILON) for their entire notice period regardless of whether they have mitigated their loss (got another job). It is therefore possible for Claimants to double their money by getting a new job quickly and receiving remuneration in that job as well as getting paid PILON in their Unfair Dismissal claim!

The same case also confirmed that if an employee would have been unable to work their notice due to sickness, and would (if not under notice or dismissed) have ordinarily only received SSP because they were sick, they should only receive SSP for their notice period or PILON because that is all they would have earned if they were not working notice or if they had not been dismissed.
