Equality Bill

The Equality Bill went through the House of Commons this week and will go to the House of Lords for more scrutiny before it can be passed as legislation. A further amendment to the Bill was made this week to outlaw the use of pre-employment questionnaires about health and disability. The aim is to strengthen the protection for those who are disabled under the DDA.
Under the amendment employers will be deterred from asking questions about health until after the employee has met some of the non-health related criteria for the role. If they ask inappropriate questions then this may be direct discrimination. However, the Bill lists some circumstances where employers can ask such questions including for making reasonale adjustments to the recruitment process.
