Inadequate Reasons - Grounds of Appeal

by Liam

This case at the EAT is an example of the sort of Tribunal decision that could give rise to a successful appeal on the basis that the reasons of the Tribunal weren’t expressed sufficiently. Tribunals must give the parties sufficient reasons for them to understand why they won or lost. In this case, those reasons were not discernable from the judgment.

The judgment also gives a brief reference to the key cases on constructive dismissal.
