Jarndyce and Jarndyce re-visited
by Philip
This case brought to mind the fictional one of Jarndyce v Jarndyce.
A Dr Abegaze who could be described as a person fond of litigating brought a case of Race Discrimination alleging he had been discriminated against at the recruitment stage. He won the case. That was back in 2000. For various reasons, some relating to ill health, some relating to Dr Abegaze’s refusal to be examined by the Respondent’s Doctor, the claim did not reach remedy until November 2006. At that point the claim was dismissed because of the delay by Dr Abegaze. Needless to say the appeal was also dismissed.
Now I’m sure even Alanis Morrissette could find some irony in a situation where a regular litigant, finally wins a case, but then snatches defeat from the jaws of victory because of his error in delaying.
Talking about victory, I am pleased to report that the claim brought against PJH law by a serial litigant was also dismissed.
