Long term sick pay

by Philip

The Employment Appeal Tribunal has confirmed that employers are not obliged to pay salary for those on long-term sick who have a disability under the Disability Discrimination Act 1995.  This would not normally be viewed as a reasonable adjustment under the Act as it would not help the employee return to work.  The case can be found here Download fowlet_case.doc and reaffirms the earlier decision in O’Hanlon v HMRC.
