Modified Grievance Procedure

 Where the employer and the employee agree to use the modified grievance procedure, where the employment has ended, the employee must set out the basis of her grievance in writing. If a subsequent Tribunal claim from the employee differs from the basis of the grievance then the Tribunal can disbar the employee from proceeding. In this case the employee was disbarred from proceeding because the ET1 claim for equal pay was put on a different basis to her grievance during the modified grievance procedure.
