Muslim waitress claims sexual harassment

Miss Lemes was a Muslim women who started work as a waitress at the Rocket Bar in May 2009. A week after she had commenced work she was asked to wear their summer outfit, which was described to the Tribunal as “a brightly coloured, figure hugging garb.” Miss Lemes refused to wear the outfit claiming that it was indecent and she might as well be naked. She felt she would be on show “as if she was being presented as one of the attractions which the Rocket Bar was offering its customers.” Miss Lemes also claimed that as a Muslim she was not used to wearing sexually attractive clothes.

Miss Lemes subsequently resigned and claimed sexual harassment.

The Employment Tribunal described the £20,000 that Miss Lemes claimed as “manifestly absurd,” however, they did uphold her claim and awarded her £3,000 for loss of earnings and injury to feelings.
