Notification

If an employer is proposing to dismiss 20 or more employees as redundant in a 90 day period, then it is required to notify the BERR of that fact on form HR1.

A failure to notify will leave the Directors liable to a criminal conviction and a fine of £5000.00.

The requirements mirror those of section 188 in that the employer must notify at least 30 days in advance where proposing to dismiss between 20 and 99, and 90 days in advance where proposing to dismiss 100+ as redundant.
