Changes to Terms and Conditions of employment after a TUPE transfer are the subject here. In summary, changes which benefit the employee will be allowed. Changes that do not benefit the employee will be void.

Dear Sir Or Madam, I worked for a firm that lost a contract to a other firm and was a subject of Tupe. If the other firm then sub contract the work out and i end up working for the sub contract firm that (i am not very happy working for). Do i have any case against the firm that has the contract..I have heard that the firm that i am presently working for is a subsidery of the firm who won the contract but that is only hear say, i or any of my colleagues have never been told this officiely.. Your have several rights under TUPE:
- To be given information and consulted with about the transfer
- To object to the transfer (before it happens) and leave on the transfer date if you don’t want to work for the new Company
- To work for the transferee on the same terms and conditions (except pension) as you did before the transfer
- Not to be dismissed for a reason connected with the transfer
