Serial Litigants

by Nicky

We at PJH Law have dealt with serial litigants, to our knowledge, on only a number of occasions. However, solicitors nationally are aware of the increasing numbers of false claims being made by serial litigants in a bid to earn some “easy money” and, quite frankly, it would appear to pass the time of day.

One solicitor has decided to face this problem head on and has drawn up a list of 30 serial litigants, one of whom is believed to have been involved in 150 allegations of discrimination! This one individual has brought discrimination claims for jobs applied for across a range of different disciplines. He has alleged that adverts incorporating words such as “recent graduate” and “school leaver” are discriminatory.

Whilst decisions may be made against serial litigants, and costs orders may be made, consideration must be given to the costs incurred by employers by either defending these claims or offering settlements on a commercial basis.

What are your experiences? How can this increasing problem be solved?
