Step One - How far to go?

The Step one letter in the dismissal and disciplinary procedure requires the employer to set out in writing the employee’s alleged conduct or characteristics. How much information do you need to provide to satisfy this requirement? A recent case suggests that the threshold is low. The EAT said it is legitimate for a tribunal “to take into account whether the document would have been seen by the employee to have been ambiguous or to have left him in doubt.��? It is therefore important to ensure that your employee will be clear when reading the letter what the charges are against him.
