Update on the Age Discrimination Challenge

We still await the outcome of Heyday’s challenge to the Age Discrimination Regs as reported on our site on 31st October 2006. However, in a spanish case the Advocate General held that national law was not incompatible with the EU Directive as it does not apply to state laws setting retirement and even if it did, such a national provision is justified. Our view from day one has been that Heyday’s challenge will not succeed, which has just been affirmed by this case. We will report the outcome of the Heyday challenge as soon as it is known.
