Working on beyond retirement

With the Age Discrimination provisions now in full swing we often have to deal with procedural points on the new request to work on beyond retirement provisions. The legislation provides that an employer has a duty to consider the request and not a duty to grant it.
The bizarre loophole in the legislation is that when declining the request the employer does not have to give a reason for the refusal. This is directly at odds with other “duty to request legislation” such as flexible working. Some employers have a dilema as to whether to state a reason or just leave it blank, being cautious as to whether by saying something they may compromise their position. The reality we find however, is that the legislation has no real teeth in this area and those employers who previously let employees work on beyond retirement will continue to do so and those that always refused continue to.
Tonight’s Cutting Edge on Channel 4 looks at the Bus Pass Workaholics, which reportedly top one million who are on the employment workforce but of pensionable age. It promises some real characters. There are those who will continue to work as they have to, to supplement their pension incomes and those that just cannot get enough like the 86 year old entrepeneur who started a new business at 80! Inspiration or just madness - you decide!
